Terms of Service
Plain-language terms for using Tone and Fit, our website, and the optional TikTok integration. By using the app or website, you agree to these terms.
Sections
The agreement
These Terms of Service form a legal agreement between you and Tone and Fit (operated by Viral Tandel as a sole proprietorship). By installing the iOS app, visiting toneandfit.app, or connecting Tone and Fit to your TikTok account, you accept these terms in full. If you do not accept them, do not use the app or website.
Your license to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Tone and Fit on iOS devices that you own or control, for personal non-commercial use, subject to these terms.
You may not:
- Reverse-engineer, decompile, or disassemble the app
- Remove or modify any copyright, trademark, or proprietary notices
- Use the app to develop a competing product
- Use the app for unlawful purposes or in violation of any law in your jurisdiction
Your content and your rights
Photos you take or upload, color profiles you generate, and notes you save remain entirely yours. We do not claim ownership over any of it.
Because we do not transmit your content to our servers (see the Privacy Policy), there is no question of us owning, modifying, or republishing it. Your content is on your device and stays there.
TikTok integration terms
The optional TikTok integration is provided as a convenience. By connecting your TikTok account:
- You authorize Tone and Fit to upload a single piece of content (video or photo carousel) on your behalf using TikTok's official Content Posting API.
- You confirm that you have the right to publish the content (it is your own creative work or you have permission).
- You agree that the content will be subject to TikTok's Community Guidelines and Terms of Service.
- You can revoke Tone and Fit's access at any time from your TikTok account settings or from inside the app.
- Tone and Fit is not responsible for moderation, removal, or shadow-banning of content by TikTok. Disputes about a published post are between you and TikTok.
The integration uses only the minimum scopes needed (user.info.basic, video.upload, and once approved video.publish). We do not access your TikTok feed, follower list, messages, or any private data.
Disclaimers
Color analysis is a stylistic guidance system. The results Tone and Fit produces are recommendations, not medical or scientific facts. Different lighting, photo quality, and individual variations can shift results. The app is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
We do not guarantee that:
- The color analysis will match what a professional in-person colorist would say (we aim for it, but reasonable people disagree)
- The app will be available without interruption
- The app will be free of bugs (we work hard to fix them, but we are a small team)
Limitation of liability
To the maximum extent permitted by applicable law, Tone and Fit and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the app or website. Our aggregate liability for direct damages, if any are awarded by a court, is limited to the amount you paid for the app in the 12 months preceding the claim (which is typically zero, since the app is free).
Prohibited uses
You may not use Tone and Fit to:
- Upload photos of people without their consent
- Generate, share, or publish content that violates any third party's rights
- Circumvent the app's intended functionality (e.g., by spoofing photos or feeding the model adversarial inputs to test it)
- Distribute the app outside the App Store
- Engage in any activity that disrupts the service or compromises its integrity
Changes to these terms
If we materially change these terms, we will update the "Last updated" date and announce the change in the app's release notes. The version of these terms in effect when you used the app applies to that use.
Governing law
These terms are governed by the laws of the United States and the State of California, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in California, with the exception of small claims jurisdiction for individual users.
If any clause of these terms is found unenforceable, the remaining clauses remain in full force.
